Speaker Bio: Sarah Decker is a Community Outreach and Resource Planning Specialist for the Albany NY District Office of the US Department of Labor’s Wage and Hour Division. She was initially hired by the Department of Labor as a Wage and Hour Assistant in 2012, and shortly thereafter became an Investigator, a position she held for 8 years. As an Investigator, she enforced Federal labor laws, including the Fair Labor Standards Act, the Service Contract Act, the Davis-Bacon and Related Acts, the Family and Medical Leave Act, the Migrant and Seasonal Agricultural Worker Protection Act, and certain provisions set forth by the Immigration and Nationality Act regarding temporary workers with H- Visas.  In 2020, Sarah accepted a position as the Albany District’s Community Outreach and Resource Planning Specialist (CORPS).  As a CORPS, Sarah educates employees and employers about the Federal labor law requirements.  She is originally from Richmond, VA and came to federal employment by way of the Peace Corps, serving two years as an English teacher in Kazakhstan.

 

Background, Professional and industry experience Ms. Decker has a Bachelor’s Degree from Christopher Newport University in Newport News, VA. She was hired by the US Department of Labor, Wage and Hour Division in 2012 and has worked for the Department for eleven years. Eight of those years she was an Investigator, conducting investigations of employers and enforcing federal labor laws, including numerous investigations under the Fair Labor Standards Act, the Family and Medical Leave Act, and the H-2A and H-2B visa programs. Ms. Decker became a Community Outreach and Resource Planning Specialist for the Albany NY District Office in December 2020. As an Outreach Specialist, Ms. Decker conducts educational outreach to educate employees and employers about the federal labor law requirements.

 

Summary of Presentation The H-2B nonimmigrant program permits employers to temporarily hire nonimmigrants to perform nonagricultural labor or services in the United States. The Wage and Hour Division has been delegated enforcement responsibility by the Department of Homeland Security to ensure H-2B workers are employed in compliance with H-2B labor certification requirements. This presentation will go over the employer’s obligations when participating in the H-2B program. Topics include the payment of prevailing wages/offered wage, transportation and visa fees, U.S. worker protections, and other requirements.
